Terms & Conditions

For the purposes of this document, the terms “we” or “our” mean Thenadays; “you” or “your” mean the person accessing, utilizing or ordering through any of the routes available to purchase goods from us.

Use of our website and the sale and purchase of goods from our website, any listings we maintain on third party selling websites, our catalogue, or any face-to-face transactions, are governed by the terms and conditions set out below – and in additional Policy documents referenced in the appropriate sections.

1. Contract

These terms and conditions cover all sales made by and purchases made from Thenadays whether through the website or catalogue or any other method.

2. Prices, Descriptions and the Availability of Goods

a. Prices

i. Prices are subject to change without notice.

ii. Pricing other than that stated in GB Pounds Sterling (GBP) are shown for guidance only.

b. Availability

i. All goods are sold subject to availability.

ii. Where goods are temporarily out of stock, you may choose to receive a refund, a replacement item, or to receive the goods when they return to stock.

c. Descriptions / Product Details

i. Whilst we take the utmost care to ensure the product descriptions, pictures, information and prices are accurate, we do not accept liability for inaccuracies, errors or omissions. Colours may vary slightly from those shown due to the limitations of the relevant technology.

3. Order Acceptance

a. Your order is an offer by you to purchase our products and the acceptance of that order / offer is at our discretion - we maintain the right to decline orders without the need for explanation.

4. Value Added Tax (VAT)

a. United Kingdom (UK): - VAT is applicable on/for all goods supplied to consumers / addresses within the UK (unless those goods are exempt or zero rated).

b. European Union (EU) - VAT is applicable on/for all goods supplied to consumers / addresses within the EU (unless those goods are exempt or zero rated).

c. Outwith the EU - VAT is not applicable on/for any goods supplied to consumers / addresses outwith the EU and will not be charged on those orders.

Orders delivered to countries outwith the EU may be subject to local sales tax or import duty. These are not included in our prices. Recipients are liable for their payment on receipt.

5. Payment for Goods

a. All payments should be made in GB Pounds Sterling (GBP).

b. You may order online paying directly through the PayPal system, or by using a credit / debit card. Credit / debit cards are also processed through the PayPal system. PayPal accepts all major credit cards from Visa, Mastercard, American Express and Discover.

c. You may order by telephoning us and pay using your credit / debit card.

d. You may print and post your order to us and pay by credit / debit card, cheque or postal order.

e. Credit / debit card transactions for orders outside the UK will be converted by your card company to GB Pounds Sterling at the current exchange rates.

f. Cheques and postal orders should always be in GB Pounds Sterling (GBP) and made payable to “Mr Heppell”. Goods will not be despatched until the funds from your cheque / postal order have cleared at our bank. This can take up to 7 working days.

6. Offers & Promotions

a. Only one Offer Code / Promotion Code can be used per order and this must be applied at the time of order (it cannot be applied later). 

b. If you attempt to apply more than one Code, only the single largest discount will be applied.

7. Delivery of Goods

a. Pricing and further details of shipping and delivery arrangements can be found in our Shipping and Delivery Page

b. Any delivery times quoted are estimates.

c. An indication of the delivery timescale is provided on the order form and shopping basket when you are placing an order.

d. Should there be a delay to the dispatch of your order, we will contact you to make you aware of this.

e. Refunds for “missing” (undelivered) parcels will be issued in accordance with any required waiting period or time frame as set by Royal Mail or the relevant Courier company.

f. There may be some restrictions on products that mean we cannot deliver them to certain destinations – this will be indicated on the corresponding Product Details page.

8. Order Cancellation / Returns

a. Details relating to the return of items can be found on the Order Returns page.

b. We want you to be happy with your purchase – we hope this will happen every time you buy from us, but, there may an occasions when you need to return something we have sent out to you. For those occasions, we offer a no risk, no-quibble, money-back guarantee.

c. We offer refunds / replacements / exchanges on all items returned to us within 14 days of the delivery of the order to you, as long as the item(s) are returned in a resalable condition. 

d. It is your responsibility to take care of the goods before returning them, and packaging / posting them back to us in a safe and secure fashion.

e. There are some items for which we cannot accept returns:

i. Sealed computer software, (audio) CDs, DVDs which have been opened

ii. Personalised Items

iii. Made-to-order Items

iv. Self-assembly Items

v. Perishable Items / Food

vi. Hygiene Sensitive Items (underwear, earrings, bedding etc)

9. Complaints

a. We welcome feedback on our service, communications, products or any other element of our business. Should you have a comment, concern or complaint, please contact us via the Contact & Connect page.

b. We aim to acknowledge complaints within 48 hours, keep you updated as to how long it will take to resolve the issue and make sure you are informed throughout the process.

10. Offensive / Age Restricted Items

a. We take care to minimise or eradicate material which is unsuitable for children, or which is likely to cause offence, from our communications and website.

b. We may sell some items which are unsuitable for minors. When placing an order for these products you will need to declare that you are of an appropriate legal age to purchase those products.

c. Should you regard any material which is on our website as offensive, please do not hesitate to inform us by telephone or email.

11. Trademarks & Copyright 

a. “Thenadays” is a Registered Trade Mark protected by United Kingdom Trade Mark Law.

b. The website, marketing materials and any other intellectual property produced by Thenadays is owned by Thenadays and is protected by United Kingdom Copyright Law.

c. Thenadays does not hold all of the copyright for materials published on our website and in our communications.

d. All third party copyright, trademarks and patents are the property of their respective owners. This is acknowledged by Thenadays and usage implies no assertion of ownership or intended infringement.

e. Any non-authorised use (without the written consent of Thenadays), printing, copying or publishing of materials on this website (including any framing of the website), other than your fair use in the course of browsing, selecting or comparing products and ordering items from us, is prohibited.

12. Information Security; Data Processing; Your Privacy

13. Notification of Changes

a. If our Terms and Conditions, or any associated Policies, alter, we will update the details online and post a notification of the changes on our homepage, so you are made aware of them.

14. Contract Governance

a. Any contracts between you and Thenadays will be governed by the laws of England and Wales.

b. By entering into any contract, you agree to submit to the jurisdiction of the English courts.

c. These Terms and Conditions do not affect your statutory rights as a consumer.

15. Competitions 

a. Thenadays periodically holds competitions, sometimes through third party websites such as Facebook and Twitter.

b. Entry into Thenadays competitions is voluntary and we have control over the prizes and delivery. The prizes are non-refundable and cannot be exchanged.

c. The prizes can only be delivered to mainland UK
